WEST GOSHEN TOWNSHIP
BOARD OF SUPERVISORS MEETING
AUGUST 8, 2001

A regularly scheduled meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Robert S. White, at 4:00 p.m. on Wednesday, August 8, 2001, at the West Goshen Township Administration Building. All members were present. Dr. White opened the meeting with the Pledge of Allegiance to the Flag.

Dr. White opened the floor for public comment. Walter Derkacz, 832 Mystery Lane asked the Board of Supervisors and the audience to reflect back to 1776 when the human cry by the colonists of that era was "Taxation Without Representation". He noted that the colonists had little opportunities concerning their welfare. This lead to vicious situations such as the Boston Tea Party and War for Independence, which brought the nation to their knees. Mr. Derkacz stated that today in this Township we have "Taxation Without Representation" in regard to the position of Public Works Director, as the Board of Supervisors did not give the public an opportunity for input. He noted this is not a small issue as history of participatory governess gave citizens the right and obligation in the welfare of a particular domain. He questioned if history was repeating itself in the Township by not allowing the public to get involved in the creation of the position of Public Works Director. Mr. Derkacz said that the citizens must now go to war in the voting booth, as the Township has violated the democratic process in the creation of this position, and he hopes the residents emulate the process. Dr. White thanked Mr. Derkacz for his opinion, but did not agree with him.

Mr. Ed Travis, 1106 North New Street asked when the weeds growing in the roadway of North New Street would be cut. David Mushrush, Street Superintendent advised the road bank would be cut if the "brush hog" was available this year (the "brush hog" was not available last year).

Mr. Travis noted that when West Whiteland Township installed a force sewer main on North New Street, they removed five (5) speed limit signs and threw them in the weeds, and he would like to see them replaced. Mr. Mushrush, stated that North New Street is signed as required by State regulations, but added the situation would be investigated.

Mrs. Evelyn Baker, 900 Sheridan Drive stated she would like to see the enforcement of the zoning ordinances, as she feels the Township is not enforcing the ordinances. She stated that in the Fall of 2000, a garden shed was built illegally on a Paoli Pike property. When she talked to Richard Hicks, Building Official and Nancy D. Rodgers, Zoning Officer regarding the shed, she was told that the owner would move the shed, but the ground was too soft to move the shed at that time. She questioned what is being done about the shed violation. Ms. Sharon Lynn, Township Manager advised Mrs. Baker that Richard Hicks and Nancy Rodgers and Ms. Lynn met with the property owner and have since taken steps to enforce the Ordinance.

Mike Aherne, 1108 Phoenixville Pike asked how he could obtain a list of pending resolutions prior to any meeting. Ms. Sharon Lynn, Township Manager stated copies of resolutions are available at the Township administration office or on the Township web site, after adoption by the Board of Supervisors. Mr. Aherne complimented the Township on a great web site.

Dr. White announced there were no Board of Supervisor's or Township Manager's announcements.

On motion by Mr. Meakim, seconded by Mr. Little, the Board unanimously approved the Board of Supervisors meeting minutes of July 11, 2001 and July 25, 2001, with the following corrections to the July 11th minutes: Paragraph 7, 6th line – "Mr. Lewis should read Mr. Reid."

On motion by Mr. Meakim, seconded by Mr. Little, the Board unanimously approved the Treasurer's Report dated July 31, 2001, for the General Fund, the Sewer Revenue Fund, the Waste and Recycling Fund, and the Capital Reserve Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

Chief Michael Carroll gave the Police Report for the month of July, 2001.

Mr. Ralph Brown, Fire Marshal, gave the Fire Marshal Report for the month of July 2001, including the reports for Good Fellowship Club of Chester County. Goshen Fire Company report was not available for this meeting.

Mr. Richard Hicks, Building Official, gave the Building Inspection Activity Report for July, 2001.

Mr. Richard J. Craig, Township Engineer, opened and read the following bid:

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously agreed to take the bid under advisement, and if the bid meets Road Department requirements, to award as the only bid.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution 26-01 setting September 12, 2001, as the date to hold a public hearing to consider amending the West Goshen Township Zoning Ordinance Section 84-19-L to modify the maximum floor area limitation for an individual store, increasing its permitted size from 3,000 square feet to 5,000 square feet. Mr. John Jaros, Esq. Representing Wawa, Inc. was present in regard to the zoning amendment.

On motion by Mr. Meakim, seconded by Dr. White, the Board unanimously approved Resolution 27-01 setting September 12, 2001, as the date to hold a public hearing to consider amending the West Goshen Township Zoning Ordinance Section 84-55 to set forth minimum criteria for the installation, use and maintenance of exterior lighting in the township.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution

28-01, for Traffic Regulatory Signs. The traffic regulatory signs include the following:

Dr. White announced that one bid was received for the contract for Residential Collection And Disposal Of Solid Waste And Commingled Recyclable Material. He stated that the contract would be rebid changing the criteria with the option of increasing pick up from two to four days a week.

On motion by Dr. White, seconded by Mr. Little, the Board of Supervisors resigned the SBCM, Inc., T/A Short Brothers 8-lot residential subdivision plans located on the east side of Ashbridge Road. The Board of Supervisors approved/signed plans on April 25, 2001 for recording by July 24, 2001. Short Brothers let the 90-day clock expire for the Township to record the plans. Thus the need to re-sign plans for their settlement in late August 2001 and recording purposes.

On motion by Dr. White, seconded by Mr. Little, the Board of Supervisors resigned the Tiberton residential subdivision plans for the Morrow Farm off Westtown Road. The Board of Supervisors approved and signed plans on April 25, 2001 for recording by July 24, 2001. Mr. Wilkinson let the

90-day clock expire on the recording of plans. Thus the need to re-sign plans for their settlement in early September 2001 and for recording purposes.

Mr. Ernie Bouey, 1001 Little Shiloh Road questioned the Board as to whether any changes had been made to the plan. Mr. Little stated that no changes had been made since the plan was initially approved in April 2001.

On motion by Mr. Meakim, seconded by Mr. Little, the Board unanimously approved a Financial Security Agreement, Improvement and Maintenance Agreement, and Developer's Performance Bond for public improvements for the Fern Hill Village Subdivision in the amount of $172,579.00. Mr. Anthony Stancato, Jr. and Andy Wright were present for Fern Hill Village.

On motion by Mr. Little, seconded by Dr. White, the Board unanimously approved the Easement Agreements for Public Road Traffic Control Devices for installation of traffic control signals at the intersection of Phoenixville Pike and Fern Hill Road. The agreements are between the Estate of J. Horace Passmore, deceased, by and through the Executrix of his Estate, Susan Passmore Windle (now known as Susan Windle Rogers), and the Township of West Goshen. The 323 square feet easement on the north side of Goshen Road (west of Phoenixville Pike), and 272 square feet easement on the west side of Fern Hill Road (south of Phoenixville Pike) permit the installation of traffic signals within the easements. Ms. Windle and her attorney, Mr. Vince Pompo were present.

Ms. Victoria Dow, Director of the West Chester Library made a presentation to inform the Board of the various programs offered and funding needed to continue such programs. She stated that West Chester Library cards may be used in other county libraries. Their three year outreach program targeted specifically to West Goshen residents include story times for six to seven year old day campers at our parks. The library has 40,000 items, and access to sixteen other library systems. They have a full-time staff in the Children's Department. The library has four major needs and Ms. Dow made a plea to the Township Board of Supervisors to consider contributing at the rate of $1.00 per person per capita.

Ms. Peggy Neimeyer, 801 Mallard Road, a library volunteer for four years, highly praised the library's programs and outreach.

Ms. Robin Garrett, 603 Owen Road, past member of the Library Board, stated it would truly be an embarrassment if West Goshen Township did not contribute $1.00 per person.

Ms. Allison Linton, 5 Primrose Lane brought a few pictures of her family enjoying the library activities. Ms. Linton has been helping at the library for eleven years, and her four oldest children volunteer part-time at the library.

Dr. White stated the Board would take Ms. Dows' request for additional funding under advisement, and he thanked Ms. Dow and the other residents for speaking on this issue.

There being no further business, on motion by Mr. Little, seconded by Mr. Meakim, the meeting was adjourned at 4:42 p.m.

Supervisor Hearing

S-5-01

Supervisor Hearing S-2-01, which was continued from the hearing date of July 11, 2001, was called to order by Chairman Robert S. White at 4:56 p.m. All members were present.

Ronald C. Nagle, Esquire, Township Solicitor, was present to represent the Township. John E. Good, Esquire, was present to represent the applicant, Fern Hill, LLC. The applicant seeks a Conditional Use approval for the second phase of its facilities, which includes the construction of an additional 117,000 square feet of office space, medical offices and a wellness center, located in two three story buildings, and associated parking facilities. The property for which the application is filed consists of 19+ acres, and is located at 915 Old Fern Hill Road.

After the completion of the testimony of three witnesses, the hearing was adjourned. Mr. Nagle stated that the applicant may submit written argument to his office within a week from this hearing. The Board will render a decision within forty-five days of the close of the record.

The hearing adjourned at 5:41 p.m.
